These Terms of Service ("Terms") govern your access to and use of the Habbiter website, mobile application, software, content, assessments, AI-powered features, subscriptions, and related services (collectively, the "Services").
Habbiter is operated by Dziugas Sablauskas, an individual conducting business activities in Lithuania.
By creating an account, accessing, browsing, purchasing, downloading, or otherwise using the Services, you agree to be legally bound by these Terms.

Habbiter may introduce, modify, remove, replace, redesign, suspend, discontinue, or experiment with features, products, services, assessments, AI systems, archetypes, frameworks, content, recommendations, interfaces, subscription offerings, and functionality at any time.
Users acknowledge that platform evolution is an inherent part of the Services.
No feature, framework, assessment, archetype, recommendation system, AI capability, design element, or subscription benefit is guaranteed to remain permanently available unless explicitly required by applicable law.
Habbiter may suspend, restrict, disable, or terminate access at any time, with or without notice, if:

This limitation applies regardless of legal theory and even if Habbiter has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the total cumulative liability of Habbiter and its operator arising out of or relating to the Services, these Terms, or any user claim, regardless of legal theory, shall not exceed the greater of:
(a) one hundred euros (€100); or
(b) the total amount actually paid by the user to Habbiter during the twelve (12) months immediately preceding the event giving rise to the claim.
This limitation applies collectively to all claims, causes of action, damages, losses, liabilities, and remedies of any kind.
The existence of multiple claims shall not enlarge this limitation.
The limitations contained in these Terms form an essential basis of the agreement between the parties and apply even if any remedy fails of its essential purpose.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of Lithuania, except where applicable law provides otherwise.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
To the maximum extent permitted by applicable law, users agree that any claim arising out of or relating to the Services shall be brought only in an individual capacity and not as a plaintiff, claimant, member, or participant in any purported class action, collective action, representative action, consolidated action, or similar proceeding.
Nothing in this section limits rights that cannot legally be waived under applicable law.
These Terms, together with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between the user and Habbiter regarding the Services.
